The Ombudsman’s final decision:
The council was not at fault in the way in which it handled child care
matters and in restricting a complainant’s contact. I am discontinuing
the investigation.
The complaint
b)Failed to work in partnership with a parent who has parental responsibility;
c) Failed to respond to child protection concerns appropriately; and
10. Family court proceedings concluded in January 2012. The court order included:
• A special guardianship order to X and Y’s grandparents;
16. Mrs B says the Council has instructed other agencies not to provide her with
information about her children. The children are subject to a special guardianship
order. The Children Act 1989 (as amended) section 14C (1)(b) states that a
special guardian is entitled to exercise parental responsibility to the exclusion of
any other person with parental responsibility (apart from another special
guardian). The special guardians have the right to decide to whom information
about the children should be given. Whether or not it was based on legal advice
from the council, it is ultimately the guardians’ decision.
18. I consider the council was reflecting the special guardians’ wishes in telling relevant
agencies not to share information with Mr and Mrs B.
THE COMPLAINT TO THE LOCAL GOVERNMENT OMBUDSMAN WAS:
THE LOCAL AUTHORITY HAVE OBSTRUCTED THE HEAD TEACHER FROM SHARING THE CHILDS RECORDS.

I have been advised by the LA legal team to inform you that I am not permitted to enter into any further communication with you. I realise that is frustrating. We will of course respond to any legal instruction from the courts. To date we have received nothing despite your previous email.
