Torbay council even lie in freedom of information requests.. oh dear


How many children attend non mainstream school and how many of them are in your care, foster, care, special guardianship, adoption or any other than with their own parents.

how many parents with parental responsibility are the council
refusing to let parents recieve information from childs school

how many children are in education outside of mainstream education,
i.e special school and ymca projects, how many of the children
attending non mainstream school are in the care of your authority
or in special guardianship or adoption.

    I have been advised by the LA legal team to inform you that I am not permitted to enter into any further communication with you. I realise that is frustrating. We will of course respond to any legal instruction from the courts. To date we have received nothing despite your previous email.

  • Nigel Baggaley please see the email below Mr Kirkman, as suggested by the department we have provided it to you. As they have stated we are asking that you consider yet again your position in relation to child Kazeem information being released to Mrs Baggaley (mother). If your school continues to refuse to provide the information the step the department are seeking we take will be taken.

    The royal courts of justice Lord Justice Ward and Lord Justice Macfarlane have ordered your update on T(childs) situation. we are aware (child) is not attending (we had a full days contact with him in Torbay 3 weeks ago) we know he is attending the YMCA etc... we understand his place at your school is open until september, (child) believes he is not being salutatorly assessed, however clearly he is attending referral units where assessment is obviously taking place. His lack of education in these units is very concerning and the fact he is falling behind in mainstream education can only add to the problems that already exist for him when or if he should return to mainstream education, which of course is now highly unlikely. 

    We hope you understand that mother is vehemently against the treatment you and your school have provided to (child), the child does not deserve his situation, and the school are completely going against everything the mother of the child has aggreed or not agreed with. Action will be taken against the school should (child) have to attend a special school, as will action be took against you personally for breaching the childs human rights. 

    Much more of this treatment Mr Kirkman and i will be seeking action aswell to have disciplinary proceedures taken against you.

    This morning I have taken advice on your legal rights with regard to Te.

    I am told that we are bound by the ruling at Exeter crown court on 13th January 2012.

    I am therefore sorry to inform you we not allowed to share with you information we hold on Te. 

    You are of course at liberty to take legal action against the school. However, I am advised that our defence would be easy - we are simply following the ruling of the crown court. 

    What you actually need to do is overturn the crown court ruling. 

    We are simply not allowed to go against a court ruling.
